Terms and Conditions for Charging Services

1 § Charging Service
Quarker Corporation, a company registered in the Philippines with SEC Registration Number (2023090114641-03) and principal office at Unit 1015 Parkway Corporate Center, Corporate Avenue, Filinvest City, Alabang, 1780 Muntinlupa City, Philippines (hereinafter referred to as "Quarker"), provides a charging service for electric vehicles (hereinafter referred to as "Customer") at charging stations connected to Quarker's network.
These terms and conditions ("Terms and Conditions") govern the Customer’s use of Quarker's services, including its mobile application ("App") and charging stations located in public and private properties.
Quarker’s charging infrastructure is installed and operated at physical locations provided by their respective owners, operators, or lessees (hereafter collectively referred to as “Hosts”).
Hosts may provide specific agreements and conditions governing the use of their property or establishment.
2 § Use of the Quarker Mobile Application
The Quarker mobile application enables Customers to locate charging stations, process payments, and monitor charging sessions.
Quarker reserves the right to modify, restrict access to, or discontinue the mobile application at any time without compensation to the Customer.
The Customer shall have no claims for damages due to the temporary or permanent unavailability of the App.
3 § Use of Quarker Charging Stations
The Customer is responsible for ensuring proper connection between their vehicle and the charging station.
Charging times depend on multiple factors such as battery capacity and charger output, and Quarker does not guarantee specific charging speeds or timeframes.
Quarker and its network partners shall not be liable for any damage caused by:
- Incompatible or faulty vehicle equipment
- Improper use of charging stations
- Technical malfunctions beyond reasonable control
4 § Availability
Charging stations are generally available 24/7 unless subject to site-specific restrictions provided by Hosts.
Availability details are shown in the App.
Quarker strives to maintain operational stations but reserves the right to temporarily or permanently suspend access due to maintenance, upgrades, or force majeure without liability.
5 § Payment
Customers are liable for all charging fees, which shall be paid via credit card, debit card, or other approved payment methods through the App.
Prices displayed in the App are inclusive of VAT. Quarker reserves the right to adjust pricing based on energy costs and market conditions.
Invoiced transactions may be subject to additional administrative fees.
Failure to complete payment may result in account suspension.
Refund requests must be submitted within 14 days from the date of charging.
6 § Personal Data & Privacy
Quarker processes personal data in compliance with the Data Privacy Act of 2012 (Republic Act No. 10173). Data collected includes:
- Contact information (name, email, phone number)
- Payment details
- Charging session data
Quarker may share personal data with service providers for payment processing, system management, or legal compliance but will never sell personal data to third parties. Customers may request data access, correction, or deletion as per legal provisions.
7 § Liability & Indemnification
Limited Liability: Quarker shall not be liable for indirect, incidental, or consequential damages arising from:
- Charging station malfunctions
- Power failures
- Vehicle incompatibilities
- Accidents at charging locations
Quarker and its Hosts shall be indemnified against claims related to damages, losses, or injuries occurring at a charging site unless directly caused by gross negligence or willful misconduct of Quarker or its Hosts.
8 § Transfer of Agreement
Quarker reserves the right to assign its rights and obligations under this agreement to any affiliate or successor entity. The Customer may not transfer or assign their rights or obligations without prior written consent from Quarker.
9 § Termination & Suspension of Service
Quarker reserves the right to suspend or terminate service access if a Customer:
- Engages in fraudulent activity
- Fails to comply with payment obligations
- Uses the service in an unauthorized manner
Customers may terminate their accounts upon written notice. Prepaid balances are non-refundable unless required by law.
10 § Amendment of Terms
Quarker may update these Terms and Conditions at any time. Customers shall be notified of significant changes via email or App notification at least 30 days before enforcement. Continued use of the service constitutes acceptance of updated terms.
11 § Dispute Resolution & Governing Law
These Terms and Conditions shall be governed by Philippine law. Any disputes shall first be resolved through mediation. If unresolved, disputes shall be brought exclusively before the courts of Muntinlupa City.

This Privacy Policy describes how we collect, use, store, process, disclose, and protect your personal data in connection with your use of Quarker’s mobile app, website, services, and EV charging platform (collectively, the "Services").
1 § Definitions
- Personal Data: Any information that identifies you as an individual, directly or indirectly, including name, contact information, and identifiers.
- Processing: Any operation performed on personal data, such as collection, recording, storage, use, or disclosure.
- Data Subject: The individual whose personal data is being processed.
- Data Controller: Quarker, which determines the purposes and means of processing your personal data.
- Data Processor: Third-party service providers that process data on behalf of Quarker, such as payment gateways and hosting providers.
2 § Personal Data We Collect
We may collect the following categories of personal data:
- Account Information: Name, mobile number, email address, username, password
- Payment Information: Payment card details, billing information (processed via PayMongo or other payment processors — we do not store credit card data)
- Charging Session Data: Location of charging station, session time, kWh usage, fees paid
- Device and Technical Data: IP address, browser type, device identifiers, OS version, app usage logs
- Location Data: Real-time GPS information when using the Quarker app to locate nearby stations
We collect data:
- When you sign up for an account
- When you use a charging station
- When you contact customer support or provide feedback
- Via cookies and similar technologies (see Section 10)
3 § Purpose and Legal Basis for Processing
We collect and process personal data to:
- Provide, operate, and maintain the Services
- Authenticate your identity and authorize account access
- Process payments for charging sessions
- Improve our app, customer support, and station availability
- Conduct analytics and performance reporting
- Comply with legal obligations
Our legal bases for processing include:
- Performance of a contract (e.g., EV charging service)
- Compliance with legal obligations
- Legitimate interest (e.g., service improvement, fraud prevention)
- Consent, when required
4 § Data Sharing and Disclosures
We may share your data with:
- Service Providers: Including but not limited to PayMongo (payment processing), AWS (cloud hosting), and analytics provider
- Regulatory Authorities: If required by law, subpoena, or court order
- Business Partners: Only with explicit consent or when contractually required
- Marketing Partners: Only if you have opted into marketing communications
We ensure all third parties comply with applicable data protection laws and enter into Data Sharing Agreements or Data Processing Agreements as needed.
5 § Data Retention
We retain your personal data only as long as necessary to:
- Fulfill the purpose it was collected for
- Comply with legal and regulatory obligations
- Maintain business records for auditing, reporting, and dispute resolution
Data retention periods vary but will not exceed five (5) years after account closure, unless otherwise required by law.
6 § Your Rights as a Data Subject
As a data subject under Philippine law, you have specific rights under the Data Privacy Act of 2012. Quarker is committed to upholding these rights and ensuring you are empowered to exercise them. Below is a detailed explanation of each:
- Right to be Informed: You have the right to be informed about how your personal data will be collected, used, stored, shared, and protected. This includes knowing the purpose of data processing, the nature of the data to be collected, the identity of the data controller, the recipients or classes of recipients, and the duration for which the data will be kept. We aim to communicate these details clearly in this privacy policy and through our service channels.
- Right to Object: You can refuse or withdraw your consent to the processing of your personal data at any time, especially when processing is not necessary or is based solely on your consent. For example, if you no longer wish to receive marketing emails from us, you may opt out through the links provided or by contacting us directly. Please note, however, that objecting to necessary data processing may affect your ability to use certain Quarker services.
- Right to Access: You have the right to request and obtain a copy of any personal information we hold about you. This includes details on how your data has been processed, who it has been shared with, and the purpose behind each instance of processing. We will respond to such requests promptly, subject to any exemptions provided by law.
- Right to Rectification: You may request corrections to any personal data we hold that you believe is inaccurate or incomplete. Quarker ensures that your data remains up to date and accurate to support quality service delivery.
- Right to Erasure or Blocking: You can request the deletion or blocking of your personal data if it is no longer necessary for the purposes for which it was collected, if it is being unlawfully processed, or if you withdraw your consent. Please note that in certain legal or operational circumstances, we may retain data for a specific period even after such a request, in compliance with record-keeping obligations.
- Right to Data Portability: You have the right to obtain your personal data in an electronic or structured format so that you can reuse it for your own purposes across different services. Where feasible, we can also transmit this data directly to another data controller at your request.

- Secure infrastructure and hosting environments
- Regular security reviews and system updates

While we take all reasonable precautions to safeguard your information, no system can guarantee complete security. Users are encouraged to maintain strong passwords and be cautious with their personal data online.
8 § International Data Transfers
If data is transferred to or processed in a country outside the Philippines, we ensure adequate safeguards, including:
- Standard Contractual Clauses (SCCs)
- Binding corporate rules
- Certifications and frameworks (e.g., EU-U.S. Privacy Framework)
